This blog isn’t dead yet

So I haven’t updated recently. I’m still alive and so is this blog. I just haven’t had anything
to blog about.

First off Penn State student football tickets sold out in under an hour. Yes that’s over 21,000 tickets in about an hour. The volume was so great that it pretty much took Ticketmaster off line for 20 minutes. If you don’t believe me read this: http://www.gopsusports.com/pressreleases/pressrelease.cfm?anncid=12651

Read Oddree mother fuckers. If you don’t this very well might be Oddree’s last issue. And do you really want to be blamed for killing Oddree?

So my secret master plan idea didn’t really work. And to make it even worse, when I went to wigle for help, apparently I am violating their EULA. In case you don’t know what I was planning to do, I’ll tell you. I was going to make a php that fetched the wigle data and gave you a google earth kml. Apparently, if I write this in javascript or make it client side it DOESN’T violate the EULA but if I make the EXACT SAME thing in php it violates it. Here is the EULA:

DATA LICENSE AGREEMENT. This legal document is an agreement between you (the Licensee) and WiGLE. By clicking on “Register!” on the WiGLE Registration page, you consent to become bound by this Agreement. This Agreement constitutes the complete agreement between you and WiGLE. If you do not fully accept this Agreement, DO NOT CLICK “Register!”.

LICENSE GRANT. In consideration of clicking the “Agree” link, WiGLE grants you a non-exclusive right to use the maps and access point database (hereinafter, “the Data”) on a single computer (i.e., with a single CPU). You, or another person with your express permission and supervision, may also use the Data on any computer system owned by you at a single location provided you can: (1)guarantee that there is no possibility of its use by more than one person at a time; and, (2)that you do not receive any renumeration for the other person’s use of the Data.

RESTRICTIONS. You may not rent, lease, sublicense, transfer, distribute, telecommunicate, copy, or sell the Data in its entirety or in any part for any commercial consideration, gain, or benefit.
TERMINATION. You may terminate this Agreement by destroying and/or deleting all portions of the Data from your computer system/wireless device. This license is automatically terminated without notice if you violate any part of this Agreement.

THE DATA ARE LICENSED TO YOU FOR ENTERTAINMENT PURPOSES ONLY. WiGLE DOES NOT CONDONE, ENDORSE OR ENCOURAGE ILLEGAL ACTIVITY. YOU UNDERSTAND AND AGREE THAT THE DATA ARE NOT TO BE USED FOR ANY ILLEGAL PURPOSE. SUCH USE AUTOMATICALLY TERMINATES THIS AGREEMENT. FURTHER, YOU UNDERSTAND THAT POSSESSION OF THE DATA MAY BE RESTRICTED BY STATE OR LOCAL LAWS AND AGREE THAT YOU HAVE DETERMINED THAT POSSESSION OF THE DATA VIOLATES NO SUCH LAWS IN YOUR JURISDICTION.

THERE ARE NO WARRANTIES TO YOU OR ANY OTHER PERSON OR ENTITY FOR THE DATA EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTIBILITY AND FITNESS FOR A PARTICULAR PURPOSE. ALL SUCH WARRANTIES ARE EXPRESSLY AND SPECIFICALLY DISCLAIMED. IN NO EVENT SHALL WiGLE BE RESPONSIBLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR SIMILAR DAMAGES OR LOST DATA OR PROFITS TO YOU OR ANY OTHER PERSON OR ENTITY REGARDLESS OF THE LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

GENERAL. This Agreement constitutes the entire Agreement between you and WiGLE. You acknowledge that the terms and conditions of the Agreement are subject to change without notice. Your continued use of the Data constitutes acceptance of these and any and all modified terms and conditions. This Agreement shall be governed and construed in accordance with the laws of the State of Illinois. WiGLE reserves all rights not expressly granted. In the event of litigation, the prevailing party is entitled to full costs and appropriate relief. Waiver of any breach by WiGLE is not considered to be a waiver of any other breach. The provisions of this Agreement are severable and if any one or more are judicially determined to be illegal or unenforceable, in whole or in part, the remaining provisions or portions shall remain binding. WiGLE considers this data to be a unique and valuable asset and has the right to seek whatever equitable and legal redress which may be available for your breach of this license.

So I do not see any violations as long as I make the people login and do not gain anything out of it. So if you can give me any help on coding the connecting the the database part (the rest is pretty much done) and/or legal advise (only if you are a lawyer) please do so. It will be appreciated.
